Two deadlines in the first month decide your hit and run claim

You might assume a hit and run claim starts with finding the driver. In California it starts with paperwork. When the driver cannot be identified, the law treats that car as uninsured, and your own uninsured motorist coverage can pay your injuries. Insurance Code section 11580.2 sets three conditions. Your injury has to come from physical contact with the fleeing vehicle. You have to report the crash within 24 hours to the city police, which in Santa Monica means the Santa Monica Police Department. And you have to file a sworn statement with your insurer within 30 days after that report. Miss the report and the insurer has a ready reason to deny you.
