LAPD says a collision report is not available for at least 45 days, so get the report number and the officer's name at the scene. Reports can be requested online through LexisNexis. If the crash involved an arrest, a death, a juvenile, or happened before February 1, 2016, send a $19 check or money order to LAPD Records and Identification Division, P.O. Box 30158, Los Angeles, CA 90030. You also have a deadline of your own. Any driver in a crash with an injury, or more than $1,000 in damage to one person, must report to the DMV on form SR-1 within 10 days (Vehicle Code 16000). Many people skip it because the insurer is handling the car. Do not skip it. In those same ten days, we send preservation letters for business video, because many shops overwrite footage fast. We get your photos, the tow record, your phone data for the crash window, and any dashcam video. Do not post about the collision online, and do not give a recorded statement to the other side's adjuster before you talk to us.

What the other driver's insurance will pay, and when it will not

California's minimum auto liability limits are $30,000 per person and $60,000 per accident for injuries, plus $15,000 for property damage, on policies issued or renewed since January 1, 2025. A broken leg, a spine injury, or surgery can pass $30,000 quickly. Plenty of drivers carry only the minimum, so your own policy matters. Insurers must offer uninsured and underinsured motorist coverage (UM/UIM), and you can only drop it by a signed written agreement. If the at-fault driver has too little coverage, or none, or flees, your UM/UIM can pay. In another, he secured a $100,000 UM policy-limit recovery for a woman rear-ended by a driver who fled. Past results do not predict a similar outcome. Be careful if you were driving without insurance. Proposition 213 generally bars non-economic damages for an uninsured vehicle owner or driver, though not when the other driver is convicted of DUI. Insurers must accept or deny a claim within 40 days of proof of claim, and they cannot make unreasonably low offers. A fast, low first offer is normal. It is not a final answer.

If a city vehicle, a bus, or a bad road caused the crash

Some Venice crashes are not just driver against driver. A City of Los Angeles truck, an LADOT bus, a Metro Line 33 bus on Venice Blvd, a Big Blue Bus, or a defect in the road can put a public agency in the case. Those cases run on a short clock. You must present a written government claim to the agency within six months of the crash (Gov. Code 911.2), and if the claim is rejected in writing you have six months from that notice to file suit (Gov. Code 945.6). Claims against the City of Los Angeles go to the Office of the City Clerk, 200 N. Spring St., Room 395, City Hall, or through its online Claim for Damages portal. Email and fax are not accepted. A late-claim application may be possible, but only within a reasonable time and no more than a year after the crash (Gov. Code 911.4). The usual rule for suing a private driver is two years (Code Civ. Proc. 335.1), and property damage is three.
