Who can file when a Culver City crash takes a life

California decides who may bring a wrongful death case in Code of Civil Procedure section 377.60. If the person left no spouse, children, or grandchildren, the people who would inherit under California's intestate rules, like parents, can file. Under sections 377.30 and 377.34, the personal representative can recover what the person lost before death, like medical bills and lost earnings. So can a successor in interest who files the sworn declaration and certified death certificate that section 377.32 requires. For survival actions filed on or after January 1, 2026, that claim no longer includes the person's pain and suffering (section 377.34). Many families include stepchildren, a partner who was never formally married, or a grandparent raising a grandchild. We sort out who stands where in the first meeting. That way nobody in your family gets left out by mistake, and the court does not toss a filing over who signed it.

Two clocks, and the short one runs against the city

Most wrongful death lawsuits against a private driver or company must be filed within two years (Code Civ. Proc. 335.1). Courts ordinarily count from the date of death. Culver City adds a trap. The city runs Culver CityBus, maintains its own city streets and signals, and operates its own fleet of vehicles. If any of those played a part in the crash, you must present a written claim to the public entity within six months of the death (Gov. Code 911.2). Culver City sits where the 405, the 10, and State Route 90 meet city streets. Sepulveda Boulevard, Washington Boulevard, Culver Boulevard, Jefferson Boulevard, Venice Boulevard (State Route 187), Overland Avenue, National Boulevard, Robertson Boulevard, and La Cienega Boulevard carry the rest of the load. We are careful about labels.
